In compliance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the Sagardun Consortium informs the user of the website, prior to the provision of the service, of the formalities and obligations that must be carried out for the effective conclusion of the contract:

  • The Client undertakes to read carefully the content of the Contracting Conditions, both the General and the Particular Conditions that are reflected in the electronic order.
  • Enter the personal details and additional information essential for the provision of the service.

Through the provisions of these Conditions, the Sagardun Consortium guarantees full compliance with the applicable regulations on the defence of Consumers and Customers, protecting their legitimate interests from the beginning to the end of the contracting process for the products and services supplied through the website.

Identification of parts

On the one hand, the Sagardun Consortium, with registered address at calle Nagusia, 48, 20115 Astigarraga (Gipuzkoa) and with tax identification number G-20808986, registered in the Basque Country Register of Tourism Companies under number ASS00224, is the owner of the portals www.sagardoarenlurraldea.eus and www.elterritoriodelasidra.com and places these portals at the disposal of Internet users, in order to offer a free online search and booking service for cider houses and tourist experiences.

And on the other hand, by the User, whose identification data are those provided directly by the latter through the inclusion of their data in the different forms that the Sagardun Consortium makes available to them in order to access any of the services offered through the website owned by the Sagardun Consortium. This necessarily implies the collection of data of a personal nature, for which reason responsibility for the authenticity of the same corresponds directly and exclusively to the User.

Object of the contract

The purpose of these Conditions governing the provision of services is to regulate access to and the system for acquiring the services and contents provided by the Sagardun Consortium to the Client via its website, constituting the legal framework that develops the contractual relationship.

The services and contents shall be those available to the Client on the following websites owned by the Sagardun Consortium: www.sagardoarenlurraldea.eus and www.elterritoriodelasidra.com.

Acceptance and availability

These Conditions regulate the legal relationship deriving from the contracting processes formalised by Customers through the Consorcio Sagardun website. The Clients expressly accept full and unreserved adherence to these stipulations, in the version published by the Sagardun Consortium at the time the Client contracts the service and/or contents that are of interest to them. Therefore, the Client undertakes to read the Contracting Conditions carefully each time he/she contracts a service, given that they may have been subject to modification since the last time he/she accessed this service.

By accepting these General Contracting Conditions, the Client declares:

  • That he/she is a person with the capacity to contract.
  • That he/she has read and accepts these General Terms and Conditi

The Client will have access, always and in any case, prior to the start of the service contracting procedure, to the Contracting Conditions, which may be stored and/or reproduced on a durable medium.

Modification of the contracting conditions

The Sagardun Consortium may modify the present stipulations provided that there is sufficient cause or reason to do so.

It is understood that there is sufficient cause or reason for the modification, by way of example and without limitation, when the purpose of the modification is to:

  • Extend the range or number of services made available to Customers or improve existing ones.
  • Modify, replace or update the prices of the services offered through the website.

 

Rights and obligations of the parts

  1. Obligations of the Sagardun Consortium:

The Sagardun Consortium undertakes to comply with the following contractual obligations arising from the commercial relationship with the Client as a result of the Client contracting the services:

  • To provide, with the maximum guarantees, the Client with the service requested by the latter in accordance with the provisions of the Contractin Conditions, without breaching contractual good faith.
  • To expressly inform the Client of the existence of these Conditions prior to the start of the contracting procedure.
  • To inform the Client, prior to contracting and in a concrete, clear, precise and unequivocal manner, of the specific characteristics of the services requested, such as the price of the same and the applicable taxes.
  • To make available to the Client a copy of the text of the General Conditions.
  • Confirm to the Client, via e-mail, both their order and the reservation, if applicable, by providing them with an order number, as well as the effective completion of the contract within a maximum period of 24 hours from the Client’s acceptance of the General and Specific Contracting Conditions that are reflected in their order.
  1. Obligations of the Client:

For its part, the Client undertakes to:

  • To fully comply with the provisions of these Conditions relating to the services provided by the Sagardun Consortium.
  • To fill in the registration forms prior to the start of the contracting procedure with truthful and up-to-date information.
  • To correctly provide the bank details requested, insofar as the Sagardun Consortium reserves the right to change the collaborating bank, undertaking to inform the Client of the bank in force through these Contracting Conditions.
  • Omitting to send messages that, in any way, prevent or hinder the normal operation of the service. In any case, the Client shall be solely and fully responsible for the content of the messages he/she writes or sends, as well as for the data he/she provides and for the use of the contents of the website in an illicit or illegitimate manner.
  • Pay the price of the services, without the filing of a complaint or claim exempting him/her from this obligation.
  1. Rights of the Client:

All information provided to the Client shall be binding on the offeror under the terms established in the Terms and Conditions of Contract and, failing this and insofar as it does not oppose what is stipulated herein, by the legislation in force.

Every Client of the contracted services has the right to receive goods and services of the quality, category and requirements contracted, by virtue of the Law on Consumers and Users and the General Contracting Conditions.

The prices and rates applicable to the contracting of services by the user shall be those appearing on the website owned by the Sagardun Consortium at the time the user accesses the specific service and proceeds to initiate the contracting process.

The Sagardun Consortium reserves the right to modify the rates published on the aforementioned website whenever it deems appropriate.


Free booking service

The Sagardun Consortium offers a free online search and booking service for cider houses and tourist experiences through www.sagardoarenlurraldea.eus. Therefore, the Sagardun Consortium will not charge any commission to the customer when making the desired booking.

Cancellation of the reservation

Reservations made may be cancelled 24 hours in advance by e-mail to info@sagardoarenlurraldea.eus or by telephone on +34 943550575, always indicating the booking reference number.

Security in credit card payments

The Sagardun Consortium uses the Verified by Visa and MasterCard SecureCode authentication systems that provide a high degree of security in Internet purchases, verifying the identity of the cardholder before approving the purchase.

To verify the identity of the cardholder of the card with which you want to pay, you are required to enter a secret code or password specific to Internet purchases (similar to how ATMs are operated) and known only to the legitimate cardholder. If you do not have this code or password for Internet purchases, you can obtain it by following the steps indicated by the browser, which will connect you to your bank. This information is not shared with the shop-commerce, as this window is being shown directly to you by your bank (through Sistema 4B).

All communications use SSL 128 bit encryption levels that guarantee the confidentiality of the information. You can verify the authenticity of the password request window by examining the security certificate by clicking on the padlock icon at the bottom of the window. Direct payment at the destination

The client will pay for the total amount of the booking directly at the destination, when using the contracted service. Payment will be made in the form and manner established at the time by the service provider and you as the client (credit card, cash…).

Payment by bank transfer

At least 5 days before your arrival, you must make the transfer to our Laboral Kutxa account IBAN: ES24 // nº 3035 0214 3121 4001 3117, indicating on the transfer the number of the Locator of your reservation.

The total and final calculation of the reservation includes VAT, unless expressly not included.

Period of validity of these conditions

The period of validity of these Conditions shall be the time they remain published on the website and shall apply to the services purchased at the time these Conditions are made available.

In any case, the Sagardun Consortium reserves the right to modify them unilaterally, without this affecting the services contracted by the Clients prior to the modification, except in those cases in which the Client has changed or modified the contracted service, in which case the conditions in force at the time of the change and/or modification shall be applicable.

Invalidity and ineffectiveness of clauses

If any clause included in these Conditions is declared totally or partially null and void or ineffective, such nullity shall only affect that provision or that part of it which is null and void or ineffective, and the conditions shall remain in force in all other respects.

Applicable law and jurisdiction

The client accepts that the legislation applicable to the operation of this service is Spanish law and submits to the jurisdiction and courts of San Sebastian for the resolution of conflicts arising from the interpretation and application of this contract.

Legal notice of the instructions

By accepting these provisions, the Client undertakes to use this website and the services made available on it, in the manner and form established herein, in accordance with these instructions, being obliged not to use the website and its services for illegitimate purposes and/or contrary to the purposes established in this legal notice, which may be detrimental to the rights and/or interests of third parties or which may in any way damage this website or prevent its correct operation or that of the services offered or to be offered in the future.

Similarly, the Client shall refrain from directly or indirectly obtaining the contents provided on the website by illegitimate, illicit or fraudulent means, stealing or plagiarising them, or in any other way that contravenes the provisions of the Criminal Code and the applicable regulations.

For its part, the Client undertakes not to make any illegitimate or illicit use of the contents of the website, or any use that may directly or indirectly involve damage and/or harm to the Sagardun Consortium. Therefore, the Client shall refrain, by way of example but not limitation, from modifying, copying, distributing, publishing, transferring and/or selling any information or appearance concerning the website owned by the Sagardun Consortium.
